  • Last Will and Testament of CHARLES BOYL' ---- Monongalia county, W. VA. Will Book 1, pages 338-339 In the name of God Amen, I Charles Boyles Senior of the County of Monongalia Commonwealth of virginia being of sound mind and memory the infirm by reason of being ninety years old last August do call to mind the mortality of my Body knowing that it is appointed for men once to die and after that judgment do make & ordain this my last will and Testament. In manner & form following That is to say I Recommend my Soul to God who gave it and my body I commit to the Earth to be buried in a descent and Christian like manner And also my worldly Estate where with it hath leases God to bless me I give Devise and bequeth to my eldest son MICHAEL and to his hears and assigns that certain tract or parcel of Land in the County of Randol[h state above sad where he now lives it being a tract I purchased of nester harden for one hundred & forty seven acres as by deed for the same. Item I hereby give and devise &bequeath to my beloved son CHARLES ninety one acres of land to be laid off on the west side of the plantation where I now live it being one half of the plantation I bought of Rowark in the County of monongalia & State of above s'd I will it to him & to his hears and assigns. Item I give devise and bequeath to my belove son GILBERT the remainder of Interest rents dues and demands what so ever for ever hereafter on account the place where he now resides or money due from him. Item I give and bequeath to my two daughters PATIENCE & SARAH Ninety one acres of land on the east side of the plantation where I and my son CHRLES now live to belong to them, their heairs and assigns forever provided never the less that they pay the sum of sixth dollars to MARGRAT STEMPLE my second Daughter that is that she the said MARGARET shall have a right to demand and recover thirty dollars out of each of the shears of her other sisters in order to make her equal with them & I will that the division of the said plantation be in manner following Viz: That the psrt for CHARLES Extend from Kernses line and then across with Evans & Barker so as that his dividend or ninety one acres may extend half way across the place and that the part for PATIENCE and SARAH lay on the East side adjoining Hofmans lines. Item I give devise and bequeath to mybeloved daughter MARGARET and to her heirs and assigns all that tract or parcel of land on the branch in the State of Maryland COunty of Allegheny contaning fifty acres & like wise Sixty dollars o be paid to here by here two sisters PATIENCE & SARAH as above s'd and my will is that after my funeral charges is aid as also all just debts out of moneys due or in hand that the remainder or residue be equally divided between my three sons MICHAEL, CHARLES & GILBERT and that after my decease my wearing aparel & moveable estate be equally divided beween MICHAEL & GILBERT. Executors of this my last will and testament and charge them to execute the same according to the Literal meaning thereof that each of my sons & Daughter have the psrt willed to them & heirs forever: And I do by these presents revoke all or any other will or wills by me made and declare this and this only too be my last will and testament in witness whereof I have hereuntoset my hand and seal this thirty first day of December in the year of our Lord One thousand eight hundred and twelve - signed Sealed & Delivered as the lst will & Testament, in presenceof us witnesses.
